Terms of Service

These Terms of Service apply to SnapperHQ services at snapperhq.com and connected business subdomains. MyListingHQ is governed by separate Terms at mylistinghq.com/terms-of-service.
1. Acceptance of Terms
These Terms of Service ("Terms") are a binding agreement between you and SnapperHQ LLC, a Washington limited liability company located at 1909 Allen Ave, Moses Lake, WA 98837 ("SnapperHQ," "we," "our," or "us"). By accessing or using SnapperHQ's services, you agree to be bound by these Terms. If you do not agree, you may not use our services.
2. Description of Service
SnapperHQ is a multi-tenant SaaS platform that provides business-management and workflow tools for real estate media professionals, including:
- Professional photographers specializing in real estate
- Videographers and virtual tour creators
- 3D scanning and virtual staging professionals
- Drone operators and aerial photography specialists
- Marketing agencies serving real estate clients
- Other media service providers in the real estate industry
Our platform enables media professionals to operate under their own brand while providing:
- Client relationship management (CRM) systems
- Booking, scheduling, and order-management workflows
- Automated marketing campaign creation and management
- Custom-branded client portals and booking systems
- Media delivery and gallery management
- Payment processing and payouts via Stripe and Stripe Connect
- Analytics, reporting, and business-intelligence tools
- SMS notifications via our messaging provider sent.dm (see Section 5)
- Subdomain hosting for SnapperHQ-branded business sites
3. User Accounts and Responsibilities
3.1 Account Registration
- You must provide accurate and complete information
- You are responsible for maintaining account security
- You must be at least 18 years old to use our services
- One person or entity may not maintain multiple accounts without our written consent
3.2 User Conduct
You agree not to:
- Use the service for any illegal, fraudulent, or unauthorized purpose
- Upload, distribute, or transmit any content that infringes intellectual property rights
- Misrepresent your identity, credentials, or business qualifications
- Upload malicious code, viruses, or any harmful software
- Violate any applicable laws, regulations, or third-party platform policies
- Attempt to reverse engineer, decompile, or extract source code
- Sublicense, resell, or redistribute the service without written consent
- Submit phone numbers of recipients with whom you do not have a verified business relationship and a lawful basis for messaging
- Use SnapperHQ's SMS features to send marketing, promotional, or solicitation content (the SMS channel is transactional only)
- Bypass, falsify, or remove STOP / opt-out signals, or attempt to re-message users who have opted out
3.3 Compliance Representations (Photography Businesses)
If you use SnapperHQ as a photography business or media professional ("Photography Business"), you represent and warrant that:
- You have a legitimate business relationship with each real estate agent or other recipient whose phone number you submit to SnapperHQ
- You have a lawful basis to provide that recipient's phone number to SnapperHQ for the purposes described in our Privacy Policy
- You will comply with all applicable laws and rules regarding business communications, including the federal Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, the CTIA Messaging Principles and Best Practices, and applicable state laws (including the Florida Telephone Solicitation Act and the Washington Commercial Electronic Mail Act)
- You will not use SnapperHQ to send marketing, promotional, or solicitation messages
- You will indemnify SnapperHQ for any claims arising from phone numbers added without a lawful basis or in violation of these representations (see Section 14)
4. Independent Contractor Status; No Agency
SnapperHQ provides software-as-a-service tools to Photography Businesses. Photography Businesses are independent contractors and are solely responsible for the services they provide to their own clients (including real estate agents). Nothing in these Terms creates a partnership, joint venture, employment, agency, franchise, or fiduciary relationship between SnapperHQ and any user. SnapperHQ is not a party to any agreement between a Photography Business and its clients, and is not responsible for the quality, timeliness, or completion of any photo shoot, gallery delivery, or related service performed by a Photography Business.
5. SMS / Text Messaging Terms
SnapperHQ uses SMS to send transactional messages on behalf of Photography Businesses to their staff and to the real estate agents who book photo shoots with them. SMS messages are delivered through our messaging provider sent.dm over a 10-digit long code (10DLC) registered to SnapperHQ LLC through The Campaign Registry.
5.1 Consent
Photography business staff and account holders opt in to SMS by checking a consent box during account setup at snapperhq.com/signup. The consent box is unchecked by default and the verbatim language reads:
"I agree to receive SMS messages from SnapperHQ including account updates, delivery notifications, security codes, and customer support messages. Message frequency may vary. Msg & data rates may apply. Reply HELP for help, Reply STOP to cancel."
Real estate agents are added by Photography Businesses when scheduling a photo shoot and receive a one-time double opt-in confirmation message; no further messages are sent until the agent replies YES. The full SMS consent flow is described in our Privacy Policy.
Consent to receive SMS messages is not a condition of purchase or use of SnapperHQ services. You can use the platform without opting in to SMS, although certain time-sensitive notifications will only be available via email in that case.
5.2 Message Types and Frequency
The SnapperHQ SMS program is 100% transactional. Messages may include booking confirmations, photo shoot reminders, daily digests to photographers, photo gallery delivery notifications, two-factor authentication (2FA) sign-in codes, and customer-care responses. Frequency varies based on your account activity and shoot schedule. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
5.3 STOP and HELP
Reply STOP to any SnapperHQ SMS message to opt out at any time. Opt-outs are processed automatically and immediately. Reply HELP for support information or email info@snapperhq.com. After opting out, you may resume receiving SMS by re-checking the consent box in your account settings or by replying START, UNSTOP, or SUBSCRIBE.
5.4 No Marketing on This Channel
SnapperHQ will not use this SMS channel for marketing, promotional content, sweepstakes, contests, or third-party offers. Photography Businesses may not send such content through SnapperHQ either.
6. Payment Terms
6.1 Credit Purchases
- Credits are purchased in advance and never expire
- All credit purchases are final and non-refundable, except where required by applicable law
- We may change pricing with 30 days' advance notice; price changes do not affect credits already purchased
6.2 Stripe and Stripe Connect
SnapperHQ uses Stripe as its payment processor and Stripe Connect to facilitate payouts to Photography Businesses. By onboarding to SnapperHQ as a Photography Business, you agree to and accept Stripe's Connected Account Agreement and Stripe's Services Agreement.
- Photography Businesses are solely responsible for amounts charged to their own clients, including refunds, chargebacks, taxes, and disputes
- SnapperHQ may collect platform fees as disclosed in your account before any transaction
- Funds are processed and held by Stripe; SnapperHQ does not directly hold customer funds
- Stripe may suspend or restrict your Connected Account in accordance with its own terms; SnapperHQ is not liable for actions taken by Stripe
6.3 Advertising Costs
- You are responsible for all advertising spend on connected platforms (e.g., Facebook, Google Ads)
- SnapperHQ does not guarantee advertising performance or results
- Advertising costs are billed by the underlying ad platform and are separate from SnapperHQ credit purchases
7. Intellectual Property
7.1 Your Content
- You retain ownership of all content you upload
- You grant SnapperHQ a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and reproduce your content solely as necessary to provide the services
- You represent that you have all rights, licenses, and consents necessary for the content you upload, including model releases and underlying-property authorizations where applicable
7.2 SnapperHQ Property
- SnapperHQ owns all rights to the platform, software, and technology
- You may not copy, modify, or reverse engineer our services
- Our trademarks and logos are protected intellectual property
8. DMCA Copyright Policy
SnapperHQ respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). We respond to clear notices of alleged copyright infringement that comply with the DMCA.
8.1 Designated Agent
Notices of alleged copyright infringement should be sent to our designated agent registered with the U.S. Copyright Office under registration number DMCA-1074007:

This designation also covers content hosted on the alternate names SnapperHQ, SnapperHQ.com, MyListingHQ, and MyListingHQ.com.
8.2 Notice Requirements
A valid DMCA notice must include: (i) a physical or electronic signature of the copyright owner or authorized agent; (ii) identification of the copyrighted work claimed to have been infringed; (iii) identification of the allegedly infringing material and its location on our service (URL); (iv) your contact information; (v) a statement that you have a good-faith belief that use of the material is not authorized; and (vi) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.
8.3 Counter-Notification
If you believe content was removed in error, you may submit a counter-notification to the designated agent containing the elements specified by 17 U.S.C. § 512(g)(3). We will forward the counter-notification to the original complainant and may restore the content after 10–14 business days unless the complainant files a court action.
8.4 Repeat Infringers
It is SnapperHQ's policy, in appropriate circumstances, to terminate the accounts of users who are determined to be repeat infringers.
9. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Service Availability and Beta Features
10.1 Service Availability
- We strive for 99.9% uptime but cannot guarantee uninterrupted service
- Scheduled maintenance will be announced in advance when possible
- We are not liable for service interruptions beyond our reasonable control
- We may modify or discontinue features with reasonable notice
10.2 Beta and Experimental Features
SnapperHQ may make beta, preview, or experimental features available from time to time, including AI-powered tools. Such features are provided "AS IS" and "AS AVAILABLE", may contain bugs or errors, may be modified or discontinued at any time without notice, and are not subject to any service-level commitments. Use of beta features is at your own risk.
11. Prohibited Industries and Content
SnapperHQ may not be used by, or in connection with, the following industries or content categories: adult content; hate speech or harassment; sex, hate, alcohol, firearms, or tobacco-focused marketing; gambling not licensed in the user's jurisdiction; cannabis or controlled-substance sales; multi-level marketing or pyramid schemes; high-risk loan or debt-relief services; or any content that is illegal in the jurisdiction in which it is offered. We may suspend or terminate accounts found to be operating in these categories.
12. Compliance with Laws and Export Controls
You represent that you are not located in, and are not a national or resident of, any country or region subject to comprehensive U.S. trade sanctions, and that you are not on any U.S. government restricted-party list. You agree to comply with all applicable U.S. and foreign export-control and sanctions laws when using SnapperHQ.
13. Limitation of Liability
Important Legal Notice
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPPERHQ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).
14. Indemnification
You agree to defend, indemnify, and hold harmless SnapperHQ LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your infringement of third-party rights; (d) your violation of the TCPA, CAN-SPAM, CTIA Messaging Principles, or any state SMS or telemarketing law in connection with phone numbers you submitted to SnapperHQ; or (e) any content you upload or transmit through the service.
15. Suspension and Termination
15.1 Suspension
We may suspend access to your account, with or without notice, if we reasonably believe you have violated these Terms, if your use threatens the security or integrity of the service, or if required to comply with applicable law or carrier requirements.
15.2 Termination by You
- You may cancel your account at any time
- You remain responsible for all charges incurred before cancellation
- Unused credits remain associated with your account and do not expire (see Section 6.1)
15.3 Termination by SnapperHQ
- We may terminate accounts for material Terms violations
- We may terminate the service entirely with 30 days' notice
- Immediate termination may occur for serious or repeated violations, fraud, abuse, or legal compulsion
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Grant County or King County, Washington, and you and SnapperHQ each consent to the personal jurisdiction of those courts.
16.1 Informal Resolution
Before filing any claim, you agree to first contact us at legal@snapperhq.com and attempt in good faith to resolve the dispute informally for at least 30 days.
16.2 Class-Action Waiver
To the fullest extent permitted by law, you and SnapperHQ each waive the right to participate in any class action, collective action, or representative proceeding against the other. Claims must be brought in an individual capacity only. If a court rules this waiver unenforceable, the unenforceable portion will be severed without affecting the remainder of these Terms.
17. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days before taking effect. Continued use of the service after the effective date of modified Terms constitutes acceptance of those modifications.
18. General Provisions
- Force Majeure. Neither party is liable for failures or delays caused by events outside its reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, civil unrest, labor disputes, internet or carrier outages, or actions of governmental authorities.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified only to the minimum extent necessary to make it enforceable.
- Entire Agreement. These Terms (together with the Privacy Policy and any product-specific terms incorporated by reference) constitute the entire agreement between you and SnapperHQ regarding the service and supersede all prior agreements on that subject.
- Assignment. You may not assign these Terms without our prior written consent. SnapperHQ may assign these Terms in connection with a merger, acquisition, financing, or sale of all or substantially all of its assets.
- Notice. We may give notice to you by email to the address associated with your account or by posting a notice in the application. You must give notice to us by email to legal@snapperhq.com with a copy by mail to the address in Section 1.
- No Waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
- Headings. Section headings are for convenience only and have no legal effect.
